The instrument would then be assigned/transferred to Merrill Lynch so that it can be used as collateral/security for the line of credit. The loan to value on this investment will be 80% loan to value. For a quick illustration is the client has a 10 Million USD SBLC or BG: then the line of credit will be 8 Million USD.

The term of the loan is the term of the particular banking instrument. So if the term of the instrument is one year and one day then the loan will be for one year and one day. However; if the client renews the instrument, then the term of the loan will also be renewed for the term of the instrument. If the client does not renew then instrument for another year then the loan is deem to be due and payable.

The client then will need to pay off the loan themselves and if the loan is not repaid, the client is liable for any payments due and any legal consequences. The instrument will not be used as collateral for forfeiture.
